These Terms of Service ("Terms") govern your access to and use of the Appealify website at appealify.net and any related tools, content, and services (together, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Appealify is — and is not
Appealify provides software-based, informational tools that help you understand a health insurance denial and prepare a written appeal. The Service may explain the likely reason for a denial, identify deadlines, present general statistics, and generate a draft appeal letter based on information you provide.
The Service does not constitute legal, medical, financial, or professional advice. Using the Service does not create an attorney–client, provider–patient, or fiduciary relationship between you and Appealify. You are solely responsible for reviewing, editing, verifying, sending, and following up on any appeal, and for all decisions you make. Outcomes depend on your insurance plan, your documentation, applicable law, and circumstances outside our control.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and your own (or that you are authorized to provide it).
3. Your responsibilities
- You are responsible for the accuracy of any information you enter, including denial text and personal details.
- You are responsible for reviewing any generated content for accuracy and suitability before relying on or submitting it.
- You are responsible for meeting your own appeal deadlines. Any deadline shown by the Service is an estimate and may be wrong; confirm deadlines with your insurer and plan documents.
- You agree not to misuse the Service, including by attempting to bypass paywalls or usage limits, reverse-engineer the Service, scrape it, overload it, or use it for any unlawful purpose.
4. Free and paid features
Some features are free; others, such as generating a full appeal letter, require a one-time payment. Prices are shown at the point of purchase and may change. Payments are processed by our third-party merchant of record (see Section 5). Details of refunds are set out in our Refund Policy.
5. Payments and merchant of record
Purchases are sold and processed by a third-party payment provider acting as the merchant of record. That provider handles the transaction, billing, applicable taxes, and receipts, and its own terms also apply to the purchase. Appealify does not store your full payment card details.
6. Intellectual property
The Service, including its design, text, and software, is owned by Appealify and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own appeal. Any appeal letter generated for you is yours to use for your own purposes; the underlying Service, templates, and software remain ours.
7. AI-generated content
The Service uses automated and AI-based systems to analyze denials and draft letters. AI output can be incomplete, inaccurate, or out of date, and may not reflect your specific plan or current law. You must independently review and verify any generated content before relying on it. Appealify is not responsible for errors in AI-generated content or for any decision you make based on it.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Appealify does not warrant that the Service will be uninterrupted, error-free, or secure, or that any appeal prepared with the Service will succeed.
9. Limitation of liability
To the maximum extent permitted by law, Appealify and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, savings, coverage, claims, or data, arising out of or related to your use of the Service. To the maximum extent permitted by law, Appealify's total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the three months before the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Appealify and its operators from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.
11. Changes to the Service and Terms
We may modify, suspend, or discontinue the Service or any feature at any time. We may update these Terms from time to time; the "Last updated" date reflects the latest version. Your continued use of the Service after changes take effect means you accept the revised Terms.
12. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or misuse the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
13. Governing law
These Terms are governed by the laws applicable at Appealify's principal place of operation, without regard to conflict-of-law rules. Any disputes will be handled in the courts of that jurisdiction, unless applicable consumer-protection law requires otherwise.
